Property in divorce: Your options and the best way forward
Approximately one in three marriages in Germany ends in divorce – and often, shared property is involved. Making the right decision regarding a house or apartment during an emotionally stressful separation is not easy. This article explores the available options and how to find the best way to handle property during a divorce.
When a divorce is imminent, it quickly becomes clear that many questions remain unanswered. Considerations are particularly complex when it comes to real estate, as property usually represents the largest shared asset. The first step for both partners to clarify is whether one of them wants to keep the house. Emotions often play a significant role in this decision, especially if there are children who want to remain in their familiar surroundings.
Nevertheless, in addition to emotional factors, the financial realities should also be carefully analyzed: Can the partner who wants to keep the house sustain the financial burden in the long term? Can he or she provide fair financial compensation to the ex-partner? If no agreement is possible or the financial burden would be too high for both sides, selling the property may be the most sensible way to create financial clarity and minimize disputes.
Dividing a property: cash settlement or partition auction?
If both partners agree that one of them will keep the property, the other must be bought out. This payout is based on the current market value of the house or apartment. To determine this value, it is advisable to consult an independent expert, such as an experienced real estate agent who knows the local market well. This ensures that the price is fair and acceptable to both parties.
However, reaching an agreement on a payout isn't always possible. If the former partners can't agree, a so-called partition auction looms – an option that is often far from ideal. This is because the property is publicly auctioned, usually at a price significantly below its actual market value. A partition auction therefore often means financial losses and additional emotional stress. It is advisable to avoid this step if possible.
Divorce without conflict: How a real estate agent can help
Especially when emotions run high during a divorce, a neutral perspective is helpful. A real estate agent can be an important mediator in such situations. They not only provide a professional and unbiased valuation of the property, but also moderate discussions between the parties and help to defuse conflicts.
A real estate agent clearly outlines the various options and their financial implications, enabling both parties to make a sound and informed decision together. It is particularly valuable if the agent has a regional network and in-depth knowledge of the local real estate market. An experienced agent guides the parties through the entire sales process – from the initial valuation to the final notary appointment – ensuring that both parties are treated fairly and transparently.
