If both partners still get along well, dividing the property can be an attractive option. Especially for couples with children, this allows both parents to live close to their offspring. And for the children themselves, the transition isn't too drastic when one apartment suddenly becomes two.
A fundamental requirement for this is, firstly, that both partners still get along well enough that the physical proximity is not a problem. Secondly, the property must also be suitable for division. Can two separate entrances be installed? Do both living units have their own bathroom and kitchen?
To divide the property into two residential units, most owners will have to undertake renovations. Depending on the extent of these renovations, this can involve significant costs.
For an official division of property, where each partner is allocated an apartment, you will also need a declaration of division. This document specifies which areas of the property or land are common property and which are private property (i.e., belonging to the respective residential unit). It also defines the rights and obligations of the owners. Even if you do not live in your property yourself but rent it out, a declaration of division is necessary. This is because it clarifies what is for common use and what is for private use only. For the declaration of division to become legally valid, it must be notarized and registered in the land register.
